The jury ultimately agreed, finding Celadon 80% liable and Martinez 20% liable and awarding approximately $750,000 for medical bills and a further $750,000 for pain and suffering, physical impairment, and disfigurement. Under Texas’s modified comparative negligence laws — which allows plaintiffs to recover compensation if they are less than 51% at fault — Martinez and O’Neal could secure the compensation they deserved for the irrevocable harm caused by the negligent truck driver.
